Think of depth as the answer to a question: at what level is the water I need to catch? A French drain works by giving water an easier path than the surrounding soil, so the perforated pipe has to sit at or below the level where water collects. Put it too shallow and the water it should intercept flows beneath it. Put it needlessly deep and you spend money, lose slope, and may never reach a workable outlet.

When the job is to collect water sheeting across the yard or pooling in a shallow low spot, the drain can sit relatively high in the soil profile. The goal is simply to intercept water near the surface and carry it off. Going deeper here buys nothing and often costs you the slope you need to daylight the pipe.
When the ground stays saturated because water is moving through the soil, the drain has to sit at the level of that moving water — typically deeper. This is a true subsurface interception, and the pipe needs to be low enough to actually catch the flow rather than perch above it.
A drain meant to relieve water pressure against a foundation is a different animal. It generally runs near the level of the footing so it can collect water before it builds against the wall. This is deeper still, and it is also where mistakes are most costly. Whatever depth you choose, the run has to fall continuously from its high end to the outlet. A French drain is a conveyance, not a reservoir. If the pipe goes flat, or dips and rises, water sits in the low spots and the system stops working. This is why depth and slope have to be designed together: every foot the trench runs, it should be dropping toward daylight, and the deepest point should be at or near the outlet end.
